We would like to congratulate the Special Rapporteur and her team for their very well documented report <u>(<\/u><a href=\"https:\/\/undocs.org\/en\/A\/HRC\/47\/34\">A\/HRC\/47\/34<\/a>) on the principle of non-punishment of victims, cornerstone of an effective protection of the rights of victims of trafficking.<\/p>\n<p>Allow me to briefly describe the Order of Malta&#8217;s contribution to the fight against human trafficking<\/p>\n<p>&nbsp;<\/p>\n<p><strong>(1) Raising awareness <\/strong><\/p>\n<ul>\n<li>Through its <a href=\"https:\/\/www.orderofmalta.int\/de\/diplomatische-aktivitaten\/bilaterale-beziehungen\/\">bilateral <\/a>(110 States) and <a href=\"https:\/\/www.orderofmalta.int\/de\/diplomatische-aktivitaten\/multilaterale-beziehungen\/\">multilateral <\/a>diplomatic network, organizing and participating in conferences<\/li>\n<\/ul>\n<p><strong>(2) Assisting victims through medical and social programs <\/strong><\/p>\n<ul>\n<li>Through its <a href=\"https:\/\/www.orderofmalta.int\/de\/malteserorden\/nationale-institutionen\/\">National Associations <\/a>and its worldwide humanitarian organization <a href=\"https:\/\/www.malteser-international.org\/de.html\">&#8220;Malteser International&#8221;.<\/a><\/li>\n<li>With a pilot project in Lagos: <a href=\"https:\/\/www.orderofmalta.int\/de\/2019\/04\/02\/einweihung-zentrums-bakhita-lagos-unterstuetzung-frauen-opfer-menschenhandel-sind\/\">&#8220;Bakhita Centre&#8221; <\/a>with <a href=\"https:\/\/stlouissisters.org\/news\/113-2012\/154-patricia-ebegbulem-ssl-receives-highest-papal-award\">Sr Patricia Ebegbulem, SSL <\/a>(Sisters of Saint Louis)<\/li>\n<li>Gathering and disseminating good practices on the site <a href=\"http:\/\/www.christusliberat.org\/\">www.christusliberat.org<\/a><\/li>\n<\/ul>\n<p><strong>(3) Training caregivers online <\/strong>(in English and soon French on <a href=\"http:\/\/www.cuhd.org\/\">www.cuhd.org <\/a>)<br \/>\nand establishing partnerships with universities (Webster, Geneva, and Nice)<\/p>\n<ul>\n<li>Webster: <a href=\"https:\/\/www.youtube.com\/watch?v=_KeDIf32ax0&amp;feature=youtu.be\">&#8220;The Use and Abuse of High Technology in Human Trafficking<\/a>&#8221; (2020).<\/li>\n<li>Nice: Research Center (2021) (<a href=\"http:\/\/web.univ-cotedazur.fr\/labs\/ladie\/fr\/recherche\/chaires-jean-monnet\">&#8220;Legal Clinic&#8221;) on the implementation of the 2011 European Union Directive against trafficking in human beings <\/a><br \/>\n<strong>(4) Organizing 12 webinars on human trafficking <\/strong>( <a href=\"http:\/\/www.adlaudatosi.org\/\">www.adlaudatosi.org<\/a> ) with Chinese, English, French, <a href=\"https:\/\/www.bigmarker.com\/cuhd-coll-ge-universitaire\/Religi-se-die-sich-f-r-die-Genesung-der-Opfer-von-Menschenhandel-einsetzen-VIDEO-AUF-ANFRAGE?utm_bmcr_source=adlaudatosi_org\">German, Italian, Russian and Spanish subtitles <\/a>in cooperation with Sr. Mirjam Beike, Congregation of the <a href=\"https:\/\/www.rgs.care\/\">Sisters of Our Lady of Charity of the Good Shepherd (RGS)<\/a>.<\/li>\n<\/ul>\n<p>This principle of non-punishment is fundamental in the fight against human trafficking in that it is central to the protection of victims but also contributes to law enforcement efforts. On the other hand, sanctioning victims discourages them from seeking assistance and justice from law enforcement and contributes to the impunity of traffickers since it is the victims and not the perpetrators who are prosecuted.\u00a0 Failure to respect the principle of non-punishment leads to further serious human rights violations, including detention, forced return and refoulement, arbitrary deprivation of citizenship and unfair trial. Ultimately, punishment hinders the possibility of recovery and is a denial of access to justice for trafficked persons. It also limits the effectiveness of prevention measures and limits the implementation of States\u2019 obligations of effective prevention.<\/p>\n<p>The Order of Malta supports the recommendations of the Special Rapporteur calling upon Member States to ratify and implement all relevant international and regional instruments that prohibit human trafficking and to introduce specific provisions on non-punishment in their national legislation.<\/p>\n<p>&nbsp;<\/p>\n<p>The Order of Malta would welcome an increased collaboration with the Special Rapporteur on Trafficking in Persons.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p style=\"text-align: center\"><strong>Conseil des Droits de l\u2019Homme &#8211; A\/HRC\/47\/34<\/strong><\/p>\n<p style=\"text-align: center\"><strong>\u00a0Rapport de la Rapporteuse sp\u00e9ciale sur la traite des \u00eatres humains,\u00a0 <\/strong><\/p>\n<p style=\"text-align: center\"><strong>en particulier les femmes et les enfants, Siobh\u00e1n Mullally<\/strong><\/p>\n<p style=\"text-align: center\">Rapport sur l\u2019application du principe de non-sanction<\/p>\n<p style=\"text-align: center\"><strong>\u00a0<\/strong><\/p>\n<p style=\"text-align: center\"><strong>D\u00e9claration du Professeur Michel Veuthey<\/strong><\/p>\n<p style=\"text-align: center\"><strong>Ambassadeur pour combattre la traite des \u00eatres humains, Observateur Permanent Adjoint<\/strong><\/p>\n<p style=\"text-align: center\"><strong>Gen\u00e8ve, 28 juin 2021<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>Madame la Pr\u00e9sidente, Excellences,<\/p>\n<p>&nbsp;<\/p>\n<p>L&#8217;Ordre Souverain de Malte souhaite exprimer ses meilleurs v\u0153ux \u00e0 la Rapporteuse sp\u00e9ciale sur la traite des \u00eatres humains, en particulier des femmes et des enfants, le Professeur Siobh\u00e1n Mullally. Nous souhaitons f\u00e9liciter la Rapporteuse sp\u00e9ciale et son \u00e9quipe pour leur rapport tr\u00e8s bien document\u00e9 (A\/HRC\/47\/34) sur le principe de non-sanction des victimes, pierre angulaire d&#8217;une protection efficace des droits des victimes de la traite.<\/p>\n<p>&nbsp;<\/p>\n<p>Permettez-moi de d\u00e9crire bri\u00e8vement la contribution de l&#8217;Ordre de Malte \u00e0 la lutte contre la traite des \u00eatres humains<\/p>\n<p>&nbsp;<\/p>\n<p>(1) <strong>Sensibilisation\u00a0:<\/strong> Gr\u00e2ce \u00e0 son r\u00e9seau diplomatique bilat\u00e9ral (110 \u00c9tats) et multilat\u00e9ral.<\/p>\n<p>(2) <strong>Aide aux victimes<\/strong> par le biais de programmes m\u00e9dicaux et sociaux. Par le biais de ses associations nationales et de son organisation humanitaire mondiale &#8221; Malteser International &#8220;. Avec un projet pilote \u00e0 Lagos : &#8221; Bakhita Centre &#8221; avec Sr Patricia Ebegbulem, SSL (S\u0153urs de Saint Louis).<\/p>\n<p>(3) <strong>Formation des aidants en ligne<\/strong> (anglais et bient\u00f4t fran\u00e7ais sur www.cuhd.org ) et par des partenariats avec des universit\u00e9s (Webster, Gen\u00e8ve, et Nice) :<\/p>\n<p>(4) <strong>Organisation de 12 w\u00e9binaires<\/strong> sur la traite des \u00eatres humains ( www.adlaudatosi.org ) avec sous-titres chinois, anglais, fran\u00e7ais, allemand, italien, russe et espagnol en coop\u00e9ration avec Sr Mirjam Beike, Congr\u00e9gation des S\u0153urs de Notre-Dame de Charit\u00e9 du Bon Pasteur (RGS).<\/p>\n<p>Ce principe de non-sanction est fondamental dans la lutte contre la traite des \u00eatres humains dans la mesure o\u00f9 il est au c\u0153ur de la protection des victimes mais contribue \u00e9galement aux efforts de r\u00e9pression. En revanche, sanctionner les victimes les d\u00e9courage de demander assistance et justice aux forces de l&#8217;ordre et contribue \u00e0 l&#8217;impunit\u00e9 des trafiquants puisque ce sont les victimes et non les auteurs qui sont poursuivis.\u00a0 Le non-respect du principe de non-sanction entra\u00eene d&#8217;autres violations graves des droits de l&#8217;homme, notamment la d\u00e9tention, le retour et le refoulement forc\u00e9s, la privation arbitraire de la citoyennet\u00e9 et les proc\u00e8s in\u00e9quitables. En d\u00e9finitive, la sanction entrave la possibilit\u00e9 de r\u00e9tablissement et constitue un d\u00e9ni d&#8217;acc\u00e8s \u00e0 la justice pour les victimes de la traite.
